Silvia Department of Correction 50 Maple Street · Suite 3 Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Attorney Jed Mahoney appealing the response of the Department of Correction (Department) to a request for public records. G. L. c. 66, § 1O A; also 950 C.M.R. 32.08(1). Specifically, on October 10, 2019, Attorney Mahoney requested certain records regarding an employee who was employed at MCI Shirley Claiming to not yet have received responsive records, Attorney Mahoney petitioned this office and this appeal, SPR20/0449, was opened as a result. Current Appeal In its February 61 h response, a representative from the Department indicated that "someone has been reached out to ... and the redactions have been completed." Attorney Mahoney, in an email to this office dated March 3, 2020, claims that "although the DOC hasn't denied our request, they have unnecessarily delayed the delivery of these records." Conclusion Subsequent to the intervention by a staff member of the Public Records Division, I learned that at the date of this letter, the Department has not provided a response with respect to Attorney Mahoney's request. Accordingly, the Department is ordered to provide Attorney Mahoney with said response within ten business days, in accordance with the Public Records Law and its Access Regulations.
