Executive Office of Public Safety and Security One Ashburton Place Room 2133 Boston, MA 02108 Dear Attorney Mullaney: I have received the petition of Mikhael El-Bayeh appealing the nonresponse of the Executive Office of Public Safety and Security (EOPSS) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, on February 11, 2020, Mr. El-Bayeh requested the following records within the possession of EOPSS: • STEP enforcement activity reports for FFY 2019, 2018, 2017, 2016, 2015 • STEP expenditure reports data entry for FFY 2019, 2018, 2017, 2016, 2015 • STEP expenditure reports - enforcement for FFY 2019, 2018, 2017, 2016, 2015. Claiming to not yet have received responsive records, Mr. El-Bayeh petitioned this office and this appeal, SPR20/0506, was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that on March 17, 2020 EOPSS indicated that they intend on providing a response. However, as of the date of this letter, EOPSS has yet to provide a response with respect to Mr. El-Bayeh's request. Accordingly, EOPSS is ordered to provide Mr. El-Bayeh with a response to this request, provided in a manner consistent with this order, the Public Records Law, and its Regulations as soon as practicable. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre(a),sec.state.ma.us. Mr. El-Bayeh may appeal the substantive nature of EOPSS' response within ninety (90) days. See 950 C.M.R. 32.08(1).
