The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records March 19, 2020 SPR20/0530 Cynthia M. Page Records Access Officer Fall River Police Department 685 Pleasant Street Fall River, MA 02056 Dear Ms. Page: I have received the petition of Filip M. Cruz appealing the response of the Fall River Police Department (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1 ). Specifically, on February 26, 2020, Mr. Cruz requested a "copy of any internal affairs reports/records" for a named Officer. The Department responded by denying the request under Exemption (f). Unsatisfied with the Department's response, Mr. Cruz petitioned this office and SPR20/0530 was opened as a result. Subsequent to the intervention by a staff attorney of the Public Records Division, I learned that the Depaiiment sent the requested records to Mr. Cruz on March 13, 2020. Whereas the basis of this appeal was opened as a result of Mr. Cruz not receiving the requested records, I will now consider this administrative appeal closed. Mr. Cruz may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
