Murray Supervisor of Records March 30, 2020 SPR20/0534 Ms. Judith Lizardi Town of Norfolk – Office of the Town Clerk 1 Liberty Lane Norfolk, MA 02056 Dear Ms. Lizardi: I have received the petition of Al Quaglieri appealing the response of the Town of Norfolk Office of the Town Clerk (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on January 27, 2020, Mr. Quaglieri requested records of “all emails between the selectboard, town administrator and all town hall employees for the period from January 24, 2019 up to and including January 31, 2019 regarding an employee meeting held on January 30, 2019 at the town hall.” Previous Appeal This request is the subject of a previous appeal, SPR20/0284. See SPR20/0284 Determination of the Supervisor of Records (February 25, 2020). In my February 25, 2020 Determination, I learned that the Town provided Mr. Quaglieri a response on February 24th with respect to his request. Unsatisfied with the February 24th response provided by the Town, Mr. Quaglieri petitioned this office and this appeal, SPR20/0534, was opened as a result. Current Appeal In an email to this office dated March 14, 2020, Mr. Quaglieri states the Town did not provide “Select Chair Kevin Kalkut’s emails as part of this FOIA request…emails were provided though for former Selectman Lehan and Palumbo.” Town’s March 16th Response In its March 16th response, a representative from the Town states that “all the documents responsive to Mr. Quaglieri’s request were provided to him. Nothing was withheld or redacted.” In addition, the Town provided the requestor a link and folder containing all the documents from Mr. Kalkut’s email that were responsive to the request. Ms. Judith Lizardi SPR20/0534 Page 2 March 30, 2020 Conclusion Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Town provided an additional response on March 18th. Whereas the basis of this appeal was opened as a result of the response dated February 24th, I will consider this administrative appeal closed.
