Murray Supervisor of Records April 8, 2020 SPR20/0584 Rachel Evans Deputy General Counsel Department of Energy Resources 100 Cambridge Street, Suite 1020 Boston, MA 02114 Dear Ms. Evans: I have received the petition of Andrew Brownsword appealing the response of the Department of Energy Resources (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Mr. Brownsword requested several categories of records related to the Department’s administration of the MOR-EV program. The Department responded to Mr. Brownsword on March 24, 2020, seeking additional time to respond pursuant to G. L. c. § 10(b)(vi). Unsatisfied with this response, Mr. Brownsword petitioned this office and this appeal, SPR 20/0584, was opened as a result. Subsequent to the opening of this appeal, on April 3, 2020, the Department produced records responsive to portions of the request, and filed a petition with this office to extend the time required for its response to the remaining portion of the request. This petition has been opened as SPR 20/0637. Whereas this appeal raises the same issues presented by the Department’s petition, they will be addressed in SPR 20/0637. Accordingly, I will consider this administrative appeal closed. Mr. Brownsword may appeal the substantive nature of the Department’s April 3rd response within ninety (90) days.
