Schwartz appealing the nonresponse of the Town of Cummington (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Schwartz requested any cannabis host agreements within the possession of the Office. Claiming to not yet have received a response, Mr. Schwartz petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Town intends on providing a written response to Mr. Schwartz’s request. Accordingly, the Town is ordered to provide Mr. Schwartz with a response made in accordance with the Public Records Law, its Access Regulations and this order as soon as practicable. It is preferable to send an electronic copy of each response to this to this office at pre@sec.state.ma.us. Mr. Schwartz may appeal the substantive nature of the Town’s response within ninety days.
