Murray Supervisor of Records April 13, 2020 SPR20/0611 Ms. Ann Quirk Town of Barnstable Office of the Town Clerk 367 Main Street Hyannis, MA 02601 Dear Ms. Quirk: I have received the petition of Daralyn Heywood appealing the response of the Town of Barnstable Office of the Town Clerk (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on January 24, 2020, Ms. Heywood requested the following records within the possession of the Town: • Any financial disclosure on the amount of Town Funds spent to defend lawsuits of any nature where the Barnstable Public Schools, and/or employees of any Barnstable Public School are named as Defendant from 2010 to present. • Any specific or general funds allocated or set aside for the sole purpose to defend Lawsuits of nay nature where the Barnstable Public School and/or its employees are named as Defendant from 2010 to present. • The allegations of any lawsuit brought forth against the Barnstable Public Sc from 2010 to prstools and/or employees where they are named Defendant, regardless of legal outcome from 2010 to present. • The number and allegations and identification of named individuals of any lawsuit against the Barnstable Public Schools and or its employees named as Defendants from 2010 to present. Claiming to not yet have received responsive records, Ms. Heywood petitioned this office and this appeal, SPR20/0611, was opened as a result. Ms. Ann Quirk SPR20/0611 Page 2 April 13, 2020 Subsequent to the intervention by a staff member of the Public Records Division, it is unclear whether the Town has yet to provide a response with respect to Ms. Heywood’s request. Accordingly, the Town is ordered to provide Ms. Heywood with a response to this request, provided in a manner consistent with this order, the Public Records Law, and its Regulations as soon as practicable. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
