G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 4, 2020, Mr. Carman requested several categories of records, including draft versions of a specified document and communications involving Town officials. Subsequently, on March 21, 2020, Mr. Carman made a second request for 2 specified contracts entered into by the Town. The Department provided a response to Mr. Carman’s first request on March 18, 2020, withholding responsive records. Subsequent to the opening of this appeal, Mr. Carman informed this office that he does not wish to appeal the Town’s response to the first set of requests. At this time, it is unclear whether the Town has responded to the second request within the statutorily- mandated timeframe, or denied access to responsive records. As such, I am unable to opine on this petition at this time. Conclusion Accordingly, I will consider this administrative appeal closed. If Mr. Carman does not receive a satisfactory response to his request, he may initiate a new appeal by petitioning this office. If he wishes to appeal the substantive nature of the Town’s March 18th response, he may do so within ninety days. See 950 C.M.R. 32.08(1).
