G. L. c. 66, § 10(A); see also 950 C.M.R. 32.08(1). Specifically, on April 7, 2020, Mr. Frisch requested: “ …all communications and correspondence, regardless of physical form or characteristics including but not limited to letters, memos, emails, and voicemails, sent, received, prepared, owned, used, in the possession of or retained by, Soldiers’ Home in Holyoke Superintendent … between February 1, 2020 and April 1, 2020.” “ …all communications and correspondence, regardless of physical form or characteristics including but not limited to letters, memos, emails, and voicemails, sent, received, prepared, owned, used, in the possession of or retained by, Massachusetts Secretary of Veterans’ Services Francisco Urena regarding Soldiers’ Home in Holyoke between February 1, 2020 and April 1, 2020.” Unsatisfied with the Department’s response, Mr. Frisch appealed, and SPR20/0681 was opened as a result. Subsequent to the intervention by a staff attorney of the Public Records Division, I learned that the Department responded to Mr. Frisch’s request with a subsequent response sent on May 6, 2020. Whereas the basis of this appeal was opened as a result of the Department’s April 7th response, I will now consider this administrative appeal closed. Mr. Frisch may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
