Agnelli City Clerk City of Gardner 95 Pleasant Street Gardner, MA 01440 Dear Mr. Agnelli: I have received the petition of Paul DeMeo appealing the response of the City of Gardner (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on January 8, 2020, Mr. DeMeo requested communications between the City Law Department, the attorney for the City’s Law Office and the City Council. Previous appeals This request was the subject of previous appeals. See SPR20/0122 Determination of the Supervisor of Records (January 31, 2020); SPR20/0291 Determination of the Supervisor of Records (February 27, 2020); SPR20/0446 Determination of the Supervisor of Records (March 13, 2020). On February 13, 2020, the City provided supplemental emails along with a privilege index to Mr. DeMeo. On April 13, 2020, the City responded and provided supplemental emails and text messages. Unsatisfied with the City's response, Mr. DeMeo appealed and SPR20/0686 was opened as a result. Based on a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. DeMeo to address his concerns. Accordingly, the City is ordered to provide Mr. DeMeo with a response to his request in a manner consistent with the Public Records Law and its Access Regulations as soon as practicable. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. DeMeo may appeal the substantive nature of the City's response within ninety days.
