G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Mattison submitted a request for records within the possession of MassDOT relating to the I90 “comprehensive subsurface exploration program.” Claiming to not yet have received a response, Mr. Mattison petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from MassDOT intends on providing a written response to Mr. Mattison to his respective request. Accordingly, MassDOT is ordered to provide Mr. Mattison with a response made in accordance with the Public Records Law, its Access Regulations and this order as soon as practicable. It is preferable to send an electronic copy of each response to this to this office at pre@sec.state.ma.us. Mr. Mattison may appeal the substantive nature of MassDOT’s response within ninety days.
