Deputy Assistant Secretary Operational Services Division One Ashburton Place, Room 1017 Boston, MA 02108 Dear Attorney McAvoy: I have received the petition of Paul Singer of WGBH appealing the response of the Operational Services Division (Division) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Singer requested “instruction manuals/guidance documents/explanatory emails or memos from government employees on proper use of the Supplier Diversity Program (SDP) Plan Form #1…SDP Plan Form #2….and SDP Plan Form #3.” The Division responded to this initial request on April 22, 2020, providing responsive records and links to publicly-available records, and withholding one document pursuant to Exemption (d) of the Public Records Law. Unsatisfied with the Division’s response, Mr. Singer petitioned this office and this appeal, SPR 20/0708, was opened as a result. Subsequent to the opening of this appeal, the Division provided a response to Mr. Singer, providing additional information regarding the withheld record and the applicability of Exemption (d) to said record. Whereas Mr. Singer has informed this office that in light of this response, he does not wish to continue his appeal, I will consider this administrative appeal closed. Sincerely, Rebecca S.
