Assistant District Attorney Office of the District Attorney – Bristol District 868 Purchase Street, P.O. Box 973 New Bedford, MA 02740 Dear Attorney Lee: I have received the petition of Alan R. Gaudreau appealing the response of the Office of the District Attorney – Bristol District (DAO) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Gaudreau requested three categories of records, including information related to “candidate” or employee positions, as well as any communications between DAO employees and Probation Department that include his name or criminal docket number. The Department responded claiming to not have responsive records to the first request; denying the second request citing personnel records under Exemption (c); and denying the third request citing unique right of access under 950 C.M.R 32.06(1)(g), CORI under Exemption (a), and Exemption (d). Unsatisfied with the DAO’s response, Mr. Gaudreau petitioned this office, and SPR20/0712 was opened as a result. Subsequent to the opening of the appeal, the DAO provided a supplemental response on May 4, 2020. Whereas the DAO has sent Mr. Gaudreau a supplemental response addressing his appeal, I will consider this appeal closed. Mr. Gaudreau may appeal the substantive nature of the DAO’s May 4th response within 90 days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S. Murray Supervisor of Records cc: Alan R.
