The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records May 19, 2020 SPR20/0735 Ulysses Jacks, Esq. Senior Counsel Department of Transportation 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Jacks: I have received the petition of Mikhael El-Bayeh appealing the nonresponse of the Massachusetts Department of Transportation (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Mr. El-Bayeh requested multiple documents in the Department’s possession. Claiming to not yet have received a response, he petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department responded to Mr. El-Bayeh’s request in writing. Whereas the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
