Murray Supervisor of Records May 22, 2020 SPR20/0760 Andrea Stone City of Springfield Office of the City Clerk 36 Court Street Springfield, MA 01103 Dear Ms. Stone: I have received the petition of Emiliano Falcon-Morano appealing the nonresponse of the Springfield Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on February 4, 2020, Mr. Falcon-Morano requested: 1. “Communications between any representative of the Springfield Police Department and any representative of IBM pertaining to any facial-recognition product or service, including any material sent by IBM or any of its representatives. 2. Internal communications between representatives or employees of the Springfield Police Department relating to any IBM facial-recognition product or service. “ The Department responded to Mr. Falcon-Morano on February 19, 2020, requesting additional time to provide a response to the request. In his appeal petition, Mr. Falcon-Morano states that the Department has not provided a substantive response to the request. Subsequent to the intervention of a staff member of the Public Records Division, I learned that the Department intends to provide a response to Mr. Falcon-Morano. Order Accordingly, the Department is ordered to provide Mr. Falcon-Morano with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations as soon as practicable. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
