Touma-Conway Office of Town Clerk Town of Wilmington 121 Glen Road Wilmington, MA 01887 Dear Ms. Touma-Conway: I have received the petition of Robert Fasulo appealing the response of the Town of Wilmington (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on April 23, 2020 Mr. Fasulo requested two categories of records including “executive session minutes of the ZBA from 4/21/2020.” The Town responded on May 1, 2020, claiming attorney-client privilege. Unsatisfied with the Town’s response, Mr. Fasulo petitioned this office and appeal SPR20/0773 was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, this office was notified that the Town intends on providing a response to Mr. Fasulo with a supplemental response. Said response shall be made in accordance with the Public Records Law and its Regulations as soon as practicable. See G. L. c. 66, § 10(b)(vi). Mr. Fasulo may appeal the substantive nature of the Town’s response within 90 days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
