Records Access Officer City of Boston One City Hall Plaza, Room 615 Boston, MA 02201 Dear Attorney Williams: I have received the petition of Nina Mazzarelli appealing the response of the City of Boston (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Mazzarelli requested “email and phone data for registered landlords and property managers in the City of Boston.” Prior Appeal This request has been the subject of a previous appeal. See SPR20/0175 Determination of the Supervisor of Records (February 12, 2020). In my February 12th determination, I found that the City had not met its burden to withhold all of the information it redacted pursuant to the privacy clause of Exemption (c), and ordered the City to provide a response consistent with that order, the Public Records Law and its Regulations. The City responded on May 13, 2020, stating that “[a]fter reviewing the Supervisor’s determination the Department declines to opine further. No additional response will be provided.” The City’s response does not contain additional information or support for its Exemption (c) claim. Order Accordingly, the City is again ordered to provide Ms. Mazzarelli with a response in a manner consistent with the determination in SPR20/0175, the Public Records Law, and its Regulations without delay. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Failure to comply with this order may result in referral of this matter to the Office of the Attorney General. See G. L. c. 66, § 10A(b).
