Murray Supervisor of Records June 5, 2020 SPR20/0831 Madonna Meagher Great Barrington Housing Authority 2 Bernard Gibbons Drive Great Barrington, MA 01230 Dear Ms. Meagher: I have received the petition of Eileen Mooney appealing the response of the Great Barrington Housing Authority (GBHA) a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Mooney requested to inspect warrants. Previous Determination This request was the subject of a previous appeal. See SPR20/0742 Determination of the Supervisor of Records (May 20, 2020). In my May 20th determination, I found the GBHA provided a supplemental response. Unsatisfied with the GBHA’s response, Ms. Mooney petitioned this office, and SPR20/0831 was opened as a result. Subsequent to the opening of this appeal, GBHA provided a response to Ms. Mooney indicating “[n]o one is denying you the right to see the warrants. I stated in the first response to your appeal, warrants will be available once the office reopens and the risk of spreading COVID- 19 is minimized.” Conclusion In compliance with the Public Records Law, the Supervisor of Records may only issue determinations where a violation of G. L. c. 66, § 10 has occurred. G. L. c. 66, § 10A(a). Given that no violation of G. L. c. 66, § 10 has been asserted by Ms. Mooney in her appeal petition, I am unable to issue a determination at this time.
