Assistant City Solicitor City of Worcester Law Department 455 Main Street, Room 301 Worcester, MA 01608 Dear Attorney Thompson: I have received the petition of Brian Grossman of TECedge, LLC, appealing the response of the City of Worcester (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on February 13th, Mr. Grossman requested several documents “concerning the City's Request for Proposals No. 720- W0, Consultant – Student Information Systems, Worcester Public Schools.” Unsatisfied with the City’s response, Mr. Grossman petitioned this office and this appeal was opened as a result. The City’s Response The City initially responded in an email dated February 26th stating that the City “will require up to an additional 15 business days as permitted by the statute to compile all responsive records.” The City provided an additional response dated May 15th, stating that complications due to COVID-19 have delayed their response. Conclusion Based upon a conversation between the Public Records Division and the City, it is my understanding that the City intends on providing a response to Mr. Grossman. Accordingly, the City is ordered to provide Mr. Grossman with a response to his request in a manner consistent with the Public Records Law and its Access Regulations as soon as is practicable. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Grossman may appeal the substantive nature of the City’s response within ninety (90) days.
