The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records June 1, 2020 SPR20/0843 Ann Scales Department of Public Health 250 Washington Street Boston, MA 02108 Dear Ms. Scales: I have received the petition appealing the nonresponse of the Department of Public Health to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. DiFazio requested several categories of records within the possession of the Department. Claiming to not yet have received a response, Mr. DiFazio petitioned this office and this appeal was opened as a result. Subsequent to the request for an appeal, I learned that the Department responded to Mr. Difazio’s request with a response sent on May 29, 2020. Whereas the basis of this appeal was opened as a result of the Department’s failure to provide a written response, I will now consider this administrative appeal closed. Mr. DiFazio may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
