The Nantucket Steamship Authority 228 Palmer Avenue Falmouth, MA 02540 Dear Attorney Kenneally: I have received the petition of Nathaniel Trumbull appealing the nonresponse of The Nantucket Steamship Authority (Authority) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on April 20, 2020, Mr. Trumbull requested records regarding “earnings history in the year 2019, including amount earned and the number of hours worked, by consultants to the steamship authority.” Claiming to not yet have received responsive records, Mr. Trumbull petitioned this office and this appeal, SPR20/0849, was opened as a result. In an email response dated May 5, 2020, a representative from the Authority replied seeking an additional ten (10) business days to respond to Mr. Trumbull’s request. The Authority provided a follow-up response dated May 22, 2020 stating Mr. Trumbull’s request was “forwarded to our accounting team, which is compiling the requested documents…the document compilation will be completed next week.” Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Authority provided a response on May 28, 2020 with respect to Mr. Trumbull’s request. Whereas the basis of this appeal was opened as a result of the lack of response by the Authority to provide a written response, I will consider this administrative appeal closed. Mr. Trumbull may appeal the substantive nature of the Authority’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
