Massachusetts Emergency Management Agency 400 Worcester Road Framingham, MA 01702-5399 Dear Attorney McCarthy: I have received the petition of Matthew Rocheleau appealing the nonresponse of the Massachusetts Emergency Management Agency (MEMA) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Rocheleau requested several records within the possession of MEMA relating to emergency planning and responses. Claiming to not yet have received a response, Mr. Rocheleau petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from MEMA intends on providing a written response to Mr. Rocheleau. Accordingly, MEMA is ordered to provide Mr. Rocheleau with a response made in accordance with the Public Records Law, its Access Regulations as soon as practicable. It is preferable to send an electronic copy of each response to this to this office at pre@sec.state.ma.us. Mr. Rocheleau may appeal the substantive nature of MEMA’s response within ninety days.
