G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Carson made a request for records within the possession of the Department. Claiming to not yet have received a response, Ms. Carson petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department intends on providing a written response to Ms. Carson to her respective request. Accordingly, the Department is ordered to provide Ms. Carson with a response made in accordance with the Public Records Law, its Access Regulations and this order as soon as practicable. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Carson may appeal the substantive nature of the Department’s responses within ninety days.
