Thompson Assistant City Solicitor City of Worcester – Law Department 455 Main Street, Room 301 Worcester, MA 01608 Dear Ms. Thompson: I have received the petition of Alissa Brosnan appealing the nonresponse of the City of Worcester Office of the City Manager (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on two (2) separate occasions, March 5, 2020 and April 10, 2020, Ms. Brosnan requested records related to evidence involving the Worcester Police Department. Claiming to not yet have received responsive records, Ms. Brosnan petitioned this office and this appeal, SPR20/0911, was opened as a result. In a phone conversation with a staff member of the Public Records Division on June 11, 2020, a representative from the City notes Ms. Brosnan’s letter dated February 18, 2020 was forwarded to the Worcester Police Department. The City claims the letter is a “formal complaint against the two (2) of your Worcester Police Detectives for misconduct…and did not constitute a records request.” Subsequent to the intervention by a staff member of the Public Records Division, I learned that the City provided a response on April 22, 2020 to Ms. Brosnan and to this office on June 10, 2020. Whereas the basis of this appeal was opened as a result of the lack of response by the City, I will consider this administrative appeal closed. Ms. Brosnan may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
