Murray Supervisor of Records June 22, 2020 SPR20/0914 Greg Lucey Malden City Clerk’s Office 110 Pleasant Street First Floor Malden, MA 02148 Dear Mr. Lucey: I have received the petition of Clark Larkins appealing the nonresponse of the Malden City Clerk’s Office (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on May 26, 2020, Mr. Larkins requested various categories of records in respect to the “Community Preservation Committee (CPC) FY2020 and Friends of Oak Grove (FOOGI), CPC Applicant and their FY2020 Application in connection with the Oak Grove Community Building.” Claiming to not yet have received responsive records, Mr. Larkins petitioned this office and this appeal, SPR20/0914, was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the City was contacted via email on June 15, 2020 regarding the status of Mr. Larkins’s request. However, as of the date of this letter, the City has yet to provide a response. Consequently, the City is to provide Mr. Larkins with a response in compliance with the Public Records Law as soon as is practicable. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Larkins may appeal the substantive nature of the City’s response within ninety (90) days.
