Dear Superintendent Kuehn:

I have received the petition of Mr. Jorge Teixeira appealing the nonresponse of the Town of Hull Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on May 28, 2020, Mr. Teixeira requested “any and all documents showing the reason for removal! of the superintendent of schools from active duty. I am looking specifically for any [e]mails, [flax, [p]aper copy, [t]exts...”

Claiming to not yet have received responsive records, Mr. Teixeira petitioned this office and this appeal, SPR20/0946, was opened as a result.

Subsequent to the intervention by a staff member of the Public Records Division, I learned that Attorney Kevin Freytag of Murphy, Hesse, Toomey & Lehane, LLC, provided a response on behalf of the Schoo! with respect to Mr. Teixeira’s request on June 15, 2020.

Whereas the basis of this appeal was opened as a result of the lack of response by the School, I will consider this administrative appeal closed. Mr. Teixeira may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
