Huard Fall River Police Department 685 Pleasant Street Fall River, MA 02721 Dear Lt. Huard: I have received the petition of John D. Rousseau appealing the response of the Fall River Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on May 11, 2020, Mr. Rousseau requested, “a copy of any internal affairs reports, records, and associated information/paperwork, rap-sheet, master-sheet and any other internal history identifier/records in relation to [a named] [o]fficer.” On June 9, 2020, the Department provided a fee estimate of $135.26. Unsatisfied with the Department’s response, Mr. Rousseau appealed and SP20/0985 was opened as a result. Subsequent to the intervention by a staff attorney of the Public Records Division, I learned that the Department responded to Mr. Rousseau’s request with a subsequent response sent on June 23, 2020. Whereas the basis of this appeal was opened as a result of the Department’s June 9th response, I will now consider this administrative appeal closed. Mr. Rousseau may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S. Murray Supervisor of Records cc: John D.
