Department of Conservation and Recreation 251 Causeway Street Boston, MA 02114 Dear Attorney Tencellent: I have received the petition of Glen Ayers appealing the nonresponse of the Department of Conservation and Recreation (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on June 4, 2020, Mr. Ayers requested the following records within the possession of the Department: • Full, unedited video recordings of the Virtual Public Meetings held by the DCR Management Forestry Program on June 1 at 3:00 PM and June 3 at 3:00 PM • Full, unedited chat logs of the Virtual Public Meetings held by the DCR Management Forestry Program on June 1 at 3:00 PM and June 3 at 3:00 PM. Claiming to not yet have received responsive records, Mr. Ayers petitioned this office and this appeal, SPR20/0993, was opened as a result. It is my understanding the Department provided a response to Mr. Ayers on June 23, 2020 and provided a further response on June 24, 2020 stating, “all the available information has been provided.” With respect to the requested chat log for the June 1, 2020 meeting, the City notes “it did not record…comments and the responses to those comments hope to be posted…on or before July 15, 2020.” Given that the Department has indicated it has provided all available information, accordingly, I will consider this administrative appeal closed. Mr. Ayers may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
