Thompson Assistant City Solicitor City of Worcester - Law Department 455 Main Street, Room 301 Worcester, MA 01608 Dear Ms. Thompson: I have received the petition of John Lajoie appealing the nonresponse of the City of Worcester (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). After reviewing this information, I find that I am unable to accept the appeal at this time. The Public Records Access Regulations, which govern the procedural aspects of all appeals, provide records custodians with ten (10) business days in which a response to a public records request must be provided. See 950 C.M.R. 32.06 (2)(b); G.L. c. 66, § 10(b). The 10-day time frame in which a custodian must respond has not yet elapsed. Nonetheless, subsequent to the intervention by a staff member of the Public Records Division, I learned that the City provided a supplemental response. Mr. Lajoie may appeal the City’s response within ninety (90) days of the response. To petition an appeal, you must send the Supervisor of Records copies of the following: 1. The written request; 2. The written response, if any; and 3. A brief letter detailing the reason for the appeal.
