May Town Clerk and Records Access Officer Town of Orleans 19 School Road Orleans, MA 02653 Dear Ms. May: I have received the petition of Attorney Panebianco appealing the nonresponse of the Town of Orleans Office of the Town Clerk (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on June 24, 2020, Attorney Panebianco requested five (5) categories of records from the Town of “all documents and communications within the Town’s Planning Board, Building Department, Zoning Board of Appeals, and Manager’s Office concerning Mr. Scott Feen, Atlantic Workshop Inc. and property located at 94 Main Street in the Town of Orleans, Massachusetts, during October 1, 2017 to the present.” Claiming to not yet have received responsive records, Attorney Panebianco petitioned this Office and this appeal, SPR20/1173, was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Town provided Attorney Panebianco a response to his request. Accordingly, I will now consider this administrative appeal closed. Attorney Panebianco may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
