General Counsel Department of Developmental Services 500 Harrison Avenue Boston, MA 02118 Dear Attorney Bergeron: I have received the petition of Mr. David Kassel appealing the nonresponse of the Department of Development Services (Department) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Kassel submitted a request for “records having to do with the DPH's public reporting dashboard for COVID-19 testing results” within the possession of the Department. Claiming to not yet have received a response, Mr. Kassel petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a member of the Public Records Division, this office was notified that a response was provided, dated August 5, 2020. Whereas this matter was opened based upon the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Kassel may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
