Records Access Officer Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza Suite 3910 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Colin Dias appealing the response of the Massachusetts Department of Transportation (MassDOT) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on July 28, 2020, Mr. Dias requested “[a]ny accident report or Police report in MassDOT possession from [a named individual] 1/17/2012 accident.” Unsatisfied with the response, Mr. Dias appealed and SPR20/1262 was opened as a result. Subsequent to the intervention by a staff attorney of the Public Records Division, I learned that Mass DOT responded to Mr. Dias’ request with a subsequent response sent on July 31, 2020. Whereas the basis of this appeal was opened as a result of MassDOT’s July 28th response, I will now consider this administrative appeal closed. Mr. Dias may appeal the substantive nature of MassDOT’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
