Murray Supervisor of Records August 17, 2020 SPR20/1308 Alison Bouchard City of Fall River Office of the City Clerk 1 Government Center Room 227 Fall River, MA 02722 Dear Ms. Bouchard: I have received the petition of Ms. Marcy Ytkin appealing the nonresponse of the City of Fall River Office of the City Clerk (Office) to her request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Ytkin submitted a request for “any and all documents to include emails, text messages, cell phone records and any and all correspondence regarding the current park board commissioners/ commissioners appointments and potential appointments, removals, any legal options requested from the Corporation counsel and whether verbally or written regarding the Park Board… [including] the Mayor, Corporation Council, Chief of Staff, John Perry, Nancy Smith and City Clerk (Allison Bouchard) from November 1, 2019 to Present” within the possession of the Office. Claiming to not yet have received a response, Ms. Ytkin petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a member of the Public Records Division, this office was notified that a response was provided, dated August 6, 2020. Whereas this matter was opened based upon the Office’s lack of a written response, I will now consider this administrative appeal closed. Ms. Ytkin may appeal the substantive nature of the Office’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
