The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records August 21, 2020 SPR20/1350 Lt. Stanley Roy Worcester Police Department 911 Lincoln Square Worcester, MA 01608 Dear Lt. Roy: I have received the petition of Kathie Ellis, Esq. appealing the response of the Worcester Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Attorney Ellis requested several categories of crash reports within the possession of the Department. Claiming to not yet have received the records, Attorney Ellis petitioned this office and this appeal was opened as a result. Subsequent to the request for an appeal, I learned that the Office had responded to Attorney Ellis request with a response sent on July 22, 2020. Due to staffing issues presented by the Commonwealth’s State of Emergency, the Department has indicated that the records sought will be provided on a rolling basis. Accordingly, the Department is ordered to provide Attorney Ellis with the records sought in accordance with the Public Records Law, its Access Regulations and this order on a rolling basis. It is preferable to send an electronic copy of each response to this to this office at pre@sec.state.ma.us. Attorney Ellis may appeal the substantive nature of the Department’s responses within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S. Murray Supervisor of Records cc: Kathie Ellis, Esq.
