City of Methuen City Clerk Searles Building, Room 112 41 Pleasant Street Methuen, MA 01844 Dear Attorney Wilson: I have received the petition of Mr. Colman Herman appealing the nonresponse of the City of Methuen (City) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Herman submitted a request for various records related to expenses of the Methuen Police Department within the possession of the City. Claiming to not yet have received a response, Mr. Herman petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the City intends on providing a written response to Mr. Herman to his respective request. Accordingly, the City is ordered to provide Mr. Herman with a response made in accordance with the Public Records Law, its Access Regulations and this order as soon as practicable. It is preferable to send an electronic copy of the response to this to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the City’s response within ninety days.
