Assistant City Solicitor City of Chicopee Law Department 17 Springfield Street Chicopee, MA 01013 Dear Attorney Pikula: I have received the petition of Trevor Eckhart appealing the response of City of Chicopee (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on July 23, 2020, Mr. Eckhart requested the following records: • “All policies regarding Chicopee Police use of Amazon’s Ring Doorbell network or Neighbors app • All data kept [r]egarding the use of Amazon's Ring Doorbell/Neighbors App. This includes how they are being utilized and information regarding video retention policies. • All policies and data kept regarding Chicopee Police use of Briefcam analytics software. This includes information regarding video systems analyzed and video retention policies. • All policies and data kept regarding Chicopee Police use of automated license plate reader technology.” The City responded on July 31st. Unsatisfied with the response, Mr. Eckhart appealed and SPR20/1418 was opened as a result. Subsequent to the intervention by a staff attorney of the Public Records Division, I learned that the City responded to Mr. Eckhart’s request with a subsequent response sent on August 28, 2020. Whereas the basis of this appeal was opened as a result of the City’s July 31st response, I will now consider this administrative appeal closed. Mr. Eckhart may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
