Stone City of Springfield - Police Department 130 Pearl Street Springfield, MA 01105 Dear Ms. Stone: I have received the petition of Attorney Codagnone appealing the nonresponse of the City of Springfield Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on July 31, 2020, Attorney Codagnone requested “[a]ny and all records, arrest reports, investigative reports, police reports, crime laboratory receipts or reports, and chain of custody documentation, any notes” referencing an identified individual from January 1, 2009 to June 1, 2012. Claiming to not yet have received responsive records, Attorney Codagnone petitioned this office and this appeal, SPR20/1438, was opened as a result. Despite being notified of the opening of this appeal by a staff member of the Public Records Division, the Department has yet to provide a response with respect to Attorney Codagnone’s July 31, 2020 request. Accordingly, the Department is ordered to provide Attorney Codagnone with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Codagnone may appeal the substantive nature of the Department’s response within ninety (90) days.
