Villani Town Administrator Town of Milford 52 Main Street, Room 11 Milford, MA 01757 Dear Mr. Villani: I have received the petition of Michael DiPronio appealing the nonresponse of the Town of Milford Public Schools (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on August 2, 2020, Mr. DiPronio requested the following records: 1. “Documentation that the Milford Public Schools submitted to the Massachusetts Department of Elementary and Secondary Education to comply with 34 C.F.R. paragraph 300.132[c] and 300.133 for fiscal years 2017, 2018, 2019 and 2020.” 2. “Documentation that shows the Milford Public Schools engaged in meaningful consultation with private schools and parent representatives as required by 34 C.F.R 300.134.” Claiming to not yet have received a response, Mr. DiPronio petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Town provided Mr. DiPronio a response to his request on August 27, 2020. Whereas the basis of this appeal was opened as a result of the Town’s lack of response to Mr. DiPronio’s request, I will now consider this administrative appeal closed. Mr. DiPronio may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
