Department of Massachusetts State Police Office of the Chief Legal Counsel 470 Worcester Road Framingham, MA 01702 Dear Attorney Staples: I have received the petition of Andrew Quemere appealing the nonresponse of the Department of Massachusetts State Police (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on August 12, 2020, Mr. Quemere requested the following records regarding “all policies, procedures, training documents, technical documents, and certification records related to Scientific Content Analysis (or SCAN), a program that was created by the Laboratory for Scientific Interrogation, Inc. (LSI).” Claiming to not yet have received responsive records, Mr. Quemere petitioned this office and this appeal, SPR20/1548, was opened as a result. Despite being notified of the opening of this appeal by a staff member of the Public Records Division, the Department has yet to provide a response with respect to Mr. Quemere’s August 12, 2020 request. Accordingly, the Department is ordered to provide Mr. Quemere with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Quemere may appeal the substantive nature of the Department’s response within ninety (90) days.
