Lowell City Solicitor 375 Merrimack St # 3 Lowell, MA 01852 Dear Attorney Hucksam: I have received the petition of Andrew Quemere appealing the nonresponse of the Lowell City Solicitor (City) to request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Quemere request various records relating to the Police Department. Claiming to not yet have received a response, Mr. Quemere petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the City intends on providing a written response. Accordingly, the City is ordered to provide Mr. Quemere with a response made in accordance with the Public Records Law, its Access Regulations and this order without delay. It is preferable to send an electronic copy of the response to this to this office at pre@sec.state.ma.us. Mr. Quemere may appeal the substantive nature of the City’s response within ninety days.
