Assistant City Solicitor City of Newton Law Department 1000 Commonwealth Avenue Newton Centre MA 02459 Dear Attorney O’Keefe: I have received the petition of Andrew Quemere appealing the nonresponse of the City of Newton (City) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Quemere submitted a request for records within the possession of the City relating to police audits. Claiming to not yet have received a response, Mr. Quemere petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the City intends on providing a written response to Mr. Quemere. Accordingly, the City is ordered to provide Mr. Quemere with a response made in accordance with the Public Records Law, its Access Regulations within 10 business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Quemere may appeal the substantive nature of the City’s responses within ninety days.
