G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Herman requested the file of an identified physician within the possession of the Board. Claiming to not yet have received a response, Mr. Herman petitioned this office and this appeal was opened as a result. Subsequent to the request for an appeal, I learned that the Board responded to Mr. Herman’s request with a response sent on September 8, 2020. Whereas the basis of this appeal was opened as a result of the Board’s failure to provide a written response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Board’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
