Murray Supervisor of Records September 22, 2020 SPR20/1635 Deputy Chief David Chartrand Dracut Police Department 110 Loon Hill Road Dracut, MA 01826 Dear Deputy Chartrand: I have received the petition of Matthew Rocheleau appealing the nonresponse of the Dracut Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Rocheleau submitted a request for records within the possession of the Department relating to “payments made for legal settlements.” Claiming to not yet have received a response, Mr. Rocheleau petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department intends on providing a written response to Mr. Rocheleau after responsive records are located. Accordingly, the Department is ordered to provide Mr. Rocheleau with a response made in accordance with the Public Records Law, its Access Regulations and this order within 10 business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Rocheleau may appeal the substantive nature of the Department’s response within ninety days.
