Legal Counsel Massachusetts Parole Board 12 Mercer Road Natick, MA 01760 Dear Attorney Walsh: I have received the petition of Harold Oliver appealing the response of Massachusetts Parole Board (Board) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Oliver requested the contract between the Multi-Health Systems (MHS), the designer of the Level of Services/Case Management Inventory (LS/CMT) (Risk and Needs Assessment Tool), and the Board. Prior appeal The requested record was the subject of a prior appeal. See SPR20/876 Determination of the Supervisor of Records (Supervisor) (June 17, 2020). The prior appeal was based on the Board’s lack of response within 10 business days. I closed SPR20/876 based on the Board’s June 16, 2020 response, and the Board’s provision of records. As a result of the records received, Mr. Oliver petitioned the Supervisor, and the current appeal was opened. In its June 16th response, the Board provided portions of the MHS’ Test Disclosure Policy. Your response on behalf of the Board asserts, “[t]he attached documents are the only portions I was able to locate, within the given timeframe, after a thorough search of our records.” Mr. Oliver petitioned the Supervisor again, and his appeal was opened on September 10th. In his letter, Mr. Oliver states, “…I received a document entitled ‘Standard Contract Form’ which appears to be a cover page to a separate document. However, that document is not complete as the [P]age [N]umber references 1 of 5, and I was provided only [P]age [N]umber 1.” Based on the Board’s June 16th response, it is unclear whether the Board possesses additional responsive documents.
