Browne Burlington Police Department 45 Center Street Burlington, MA 01803 Dear Deputy Chief Browne: I have received the petition of Daniel Neal appealing the response of the Burlington Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on September 1, 2020, Mr. Neal requested: “… the Burlington Police Station video feed for the entire day of 8/30/2020 … [and] [a named Sargent’s] work cell phone records for that day 8/30/2020 including texts/pictures/phone for the entire day.” The Department responded on September 1, 2020. Unsatisfied with the response, Mr. Neal appealed and SPR20/1688 was opened as a result. Subsequent to the intervention by a staff attorney of the Public Records Division, I learned that the Department responded to Mr. Neal’s request and provided the records requested. Whereas the basis of this appeal was opened as a result of the Department’s September 1st response, I will now consider this administrative appeal closed. Mr. Neal may appeal the substantive nature of the Department’s subsequent response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
