Smith Superintendent of Schools East Longmeadow Public Schools 180 Maple Street East Longmeadow, MA 01028 Dear Superintendent Smith: I have received the petition of Mr. Michael Baxter appealing the nonresponse of the East Longmeadow Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on August 11, 2020, Mr. Baxter requested the following: 1. “All results and data collected from the first parent survey which was emailed out on or about July 13, 2020.” 2. “All results and data collected from the second parent survey which was emailed out on or about July 29, 2020.” 3. “All email correspondence that references either of the parent surveys.” Claiming to not yet have received a response, Mr. Baxter petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the School provided Mr. Baxter with a response to his request, dated September 17, 2020. Whereas the basis of this appeal was opened as a result of the School’s lack of response to Mr. Baxter’s request, I will now consider this administrative appeal closed. Mr. Baxter may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
