Grenier appealing the nonresponse of the Office of Suffolk County District Attorney (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on August 22, 2020, Mr. Grenier requested the following records within the possession of the Office: • Twenty-three (23) categories of information related to motor vehicle homicide and manslaughter cases prosecuted during a ten (10) year period • Information as to whether a 58A was filed, and if a defendant was held, whether on 58A or bail, though these issues were not explicitly addressed in the case. Claiming to not yet have received responsive records, Mr. Grenier petitioned this office and this appeal, SPR20/1715, was opened as a result. In an email correspondence to this office dated September 28, 2020, a representative of the Office states they are in the process of assembling the responsive materials and intend on providing a response with respect to Mr. Grenier’s August 22, 2020 request. Accordingly, the Office is ordered to provide Mr. Grenier with said response, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Grenier may appeal the substantive nature of the Office’s response within ninety (90) days.
