McNamara Chief of Police Stoughton Police Department 26 Rose Street Stoughton, MA 02072 Dear Chief McNamara: I have received the petitions of Kimberly Haugen appealing the response of the Stoughton Police Department (Department) to her request for public records. G. L. c. 66, §10A; see also 950 C.M.R. 32.08(1). Specifically, on September 22, 2020, Ms. Haugen requested, “… copies of all civilian complaints, disciplinary records, and internal affairs complaints, interviews, reports, conclusions and recommendations regarding the … three identified officers …” Unsatisfied with the response, Ms. Haugen appealed and SPR20/1833 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Ms. Haugen to address her concerns. Accordingly, the Department is ordered to provide Ms. Haugen with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Haugen may appeal the substantive nature of the Department's response within ninety days.
