Murray Supervisor of Records October 14, 2020 SPR20/1856 Brenda Melanson Records Department North Central Correctional Institution – Gardner 500 Colony Road Gardner, MA 01440 Dear Ms. Melanson: I have received the petition of Attorney Jason Benzaken appealing the nonresponse of the North Central Correctional Institution - Gardner (Institution) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on July 29, 2020, Attorney Benzaken requested records relating to a motor vehicle incident involving a named individual, within the possession of the Institution. Claiming to not yet have received responsive records, Attorney Benzaken petitioned this office and this appeal, SPR20/1856, was opened as a result. Despite being notified of the opening of this appeal by a staff member of the Public Records Division, the Institution has yet to provide a response with respect to Attorney Benzaken’s July 29, 2020 request. Accordingly, the Institution is ordered to provide Attorney Benzaken with a response in compliance with the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Benzaken may appeal the substantive nature of the Institution’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
