Olson City Clerk City of Newton City Hall 1000 Commonwealth Avenue Newton, MA 02459 Dear Mr. Olson: I have received the petition of Debra Waller appealing the fee estimate response of the City of Newton (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 26, 2020, Ms. Waller requested a revised fee estimate for, “[a]ll zoning enforcement actions issued by the Department of Inspectional Services for the calendar years 2012, 2014 2015 … includes all ‘Notice of Violation’ letters sent.” Previous appeal This request was the subject of a previous appeal. See SPR20/1712 Determination of the Supervisor of Records (September 29, 2020). Unsatisfied with the response, Ms. Waller appealed and SPR20/1936 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Ms. Waller to address her concerns. Accordingly, the City is ordered to provide Ms. Waller with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Waller may appeal the substantive nature of the City's response within ninety days.
